Eminent Domain & Government Takings

California Disclosure Requirements
California has some of the most extensive seller disclosure obligations in the country. Sellers of residential property must disclose all known material facts affecting the value or desirability of the property — including structural defects, pest damage, environmental hazards, neighborhood noise, pending litigation, and HOA disputes. Real estate agents have an independent duty to conduct a reasonably competent visual inspection and disclose anything that should have been discovered.
When these disclosure duties are violated, buyers have legal remedies including rescission of the purchase contract, compensatory damages for repair costs and diminished value, and in cases of intentional concealment, punitive damages.
